Albuquerque murder suspect will stay behind bars until trial 

ALBUQUERQUE, N.M. (KRQE) – A man accused of murder back in September and was shot by police while trying to flee while being arrested will remain behind bars through his trial. Julian Garcia was in front of Judge Matthew Chavez for a pretrial detention hearing Wednesday afternoon.

Witnesses told police that Garcia killed Ezekiel Brown, who had just shot and killed his uncle, James Garcia. Prosecutors argued that Garcia wouldn’t comply with court orders because he didn’t listen to officers in March when they tried to arrest him for this case. Garcia’s lawyer argued that her client reacted emotionally to what he saw, has no criminal history, and with his injuries, the court should be able to fashion conditions of release to ensure the public’s safety.

Judge Chavez disagreed, siding with the state and ruling that Garcia will remain behind bars.
