Judge: Volcano Vista student suing APS, school leaders likely to succeed with lawsuit 

ALBUQUERQUE, N.M. (KRQE) – A judge ruled an Albuquerque high school student likely has a good case against Volcano Vista High School in a lawsuit claiming her first amendment rights were violated.

Last year, that senior student posted a Snapchat message to her friends calling out the school’s activities director over his handling of an argument between her and another student.

The principal and activities director saw the message and stripped the student of her position in the student body, which the lawsuit claims violated her right to free speech. This week, a judge granted the student’s request to get her position back as student body vice president, writing that the student is “likely to prevail on the merits of her lawsuit” in court, according to federal court documents.
