SANTA FE, N.M. (KRQE) – First Judicial District Court Judge Francis Mathew had a DWI charge against him dismissed, according to First Judicial District Attorney Special Prosecutor Kari Morrissey.

The charge stemmed from Dec. 16, when Mathew was driving in Santa Fe and was stopped at a DWI checkpoint. His blood alcohol concentration was “well below the legal limit of 0.08% and other evidence of impairment was also lacking or absent,” Morrissey wrote in a Tuesday news release.
“Sufficient evidence does not exist to support a conviction beyond a reasonable doubt. This decision was made based on an analysis of all of the evidence in this case,” Morrissey added.
