ALBUQUERQUE, N.M. (KRQE) – An Albuquerque man, accused of murdering a man near a popular ATV spot, will stay behind bars.
Andrew Johns called the police last Monday, reportedly saying a friend was attacking him with a plastic pole and rocks near Montessa Park. He claimed he fired a warning shot in the air and the man ran away.
The following day, a man who matched the description given by Johns and in the same area, was found dead with a gunshot wound to the head.
The State asked for Johns to be locked up, saying he was on a protective order at the time where he was not allowed to possess any guns. They claimed this showed he would not follow court orders.
Johns’ lawyer claims his client was acting in self-defense. Judge Bruce Fox agreed with the State, keeping Johns in jail.
