DA: New evidence points to a different woman driving in fatal Albuquerque hit-and-run 

ALBUQUERQUE, N.M. (KRQE) – An Albuquerque father and marine veteran was killed by a hit-and-run driver while he was working underneath his car. Now evidence points to a different woman behind the wheel than police originally thought.

Scott Toole, 34 was killed in October of 2022. At his memorial service at Hope Covenant Church in Minnesota, his family and friends remembered him saying, “Scott really did make a big difference in this world. From being an EMT, to being a marine serving our country, and being a nurse. And that was his ultimate goal in life was to make a difference and he truly did.”

Toole was working on a Ford Expedition held up by jacks in a neighborhood near Avenida Cesar Chavez and Yale. A PT Cruiser plowed into his SUV, knocking it off the supports and killing him.

Jennifer Rue, 26, was originally identified as the driver, and witnesses reported two other women were also in the car. Rue was charged with failing to report the crash and render aid. But the charge against Rue was later dismissed, “pending further investigation,” according to court documents.

Now, new DNA evidence has the state shifting their focus to one of the other women in the car with Rue, 20-year-old Jazmin Anesi, who was questioned by officers in an unrelated incident in July of this year.

“Would you like to talk to me yes, or no?” said an officer, “No I won’t,” replied Anesi. She is accused of homicide by vehicle as a result of reckless driving and for knowingly leaving the scene of an accident.

She’s scheduled to see a judge later this month. The Bernalillo County District Attorney’s office said there are no plans at this time to refile charges against Rue.
